Identity theft affecting ITIN credit files is a growing problem — and the recovery process has unique challenges that SSN-focused guides don't cover. I'm Rick Jefferson, and here's what to do if your ITIN has been compromised.

How Identity Theft Affects ITIN Credit Files

Thieves can use your ITIN to:

  • Open fraudulent credit accounts in your name
  • File false tax returns to steal refunds
  • Create synthetic identities combining your ITIN with fake personal information
  • Run up charges on existing accounts

The damage shows up as unknown accounts, unauthorized inquiries, incorrect personal information, and mystery collections on your credit reports.

Step 1: Place Fraud Alerts and Credit Freezes

Under FCRA §605A, you have the right to place a fraud alert on your credit file. Contact any one of the three bureaus and they must notify the other two:

  • TransUnion: 1-800-680-7289
  • Equifax: 1-800-525-6285
  • Experian: 1-888-397-3742

You can also place a credit freeze (security freeze) which prevents anyone from pulling your credit report without your permission. This is free under federal law.

Step 2: File an FTC Identity Theft Report

Go to IdentityTheft.gov and file a report. This creates an official record that you can provide to creditors and collection agencies to prove fraud. Keep the report number — you'll need it for disputes.

Step 3: Dispute Fraudulent Items

File disputes under FCRA §605B with each bureau for every fraudulent account. Under §605B, when you provide an identity theft report, the bureau must block the fraudulent information within 4 business days — this is faster than the standard 30-day investigation period.

Step 4: Contact Affected Creditors

Send written notice to every creditor where fraud occurred. Under the FCBA (Fair Credit Billing Act), you're not liable for more than $50 in unauthorized charges on credit cards — and most issuers waive even that.

RJ Business Solutions Identity Theft Policy

We assist with identity theft recovery under our Premium plan, but with an important policy: RJ Business Solutions does not file, prepare, coach, or advise on FTC Identity Theft Reports, police reports, or victim-status filings under FCRA §605B or §605C. Clients who independently file such documents may submit them with a signed waiver confirming independent filing and truthfulness (violations of 18 U.S.C. §1028 and §1001 will be reported to federal authorities).

We handle the credit bureau disputes, creditor notifications, and file restoration — the credit repair work — while the legal attestation of identity theft remains your personal responsibility.

"Identity theft is devastating for anyone, but ITIN holders face an extra layer of complexity because of limited monitoring options and language barriers in the recovery process. That is exactly why we built bilingual identity theft recovery into our Premium plan."
